If I have a tea and a couple of social tea biscuits while alone am I putting myself at legal risk?

As long as there are multiple biscuits I think you are ok.

Problem with the anti-social ones is that you can't put them on the same plate as the social ones because they cancel each other out and then nobody gets anything with their tea.
