04 August 2010

My dread is that now it is on the the SCOTUS, and we know that it will be 5-4 the other way. . .

*sigh*

But yes, a good day today!

(and pup I would SO come to your wedding, IF.)

Don't be holding your breath, danf. I'm all for having the right, but still haven't decided to be the marrying kind.

This part is amazing:

"Proponents elected not to call the majority of their designated witnesses to testify at trial and called not a single official proponent of Proposition 8 to explain the discrepancies between the arguments in favor of Proposition 8 presented to voters and the arguments presented in court."

The witnesses cited fear for personal safety.

Wow, this gets better...

Re: an "expert" witness called by Prop 8 proponents: "Blankenhorn offered opinions on the definition of marriage, the ideal family structure and potential consequences of state recognition of marriage for same-sex couples. None of Blankenhorn's opinions is reliable."

Oh, snap.

So, I didn't read the full text doc fully: Has anyone brought up that the definition of one man, one woman could also be a sibling marriage? Is that scenario legal?
posted by chewatadistance 04 August | 18:38
The story does not end today, though. The decision is already stayed pending appeal. Keep your fingers crossed.

sibling marriage is prohibited by incest laws.

Ted Olsen & David Boies seem to be doing everything EXACTLY right to win this at the Supreme Court level. Everything I've read this evening has made me hopeful. I try not to get too hopeful, because this issue is SO close to home, but but but... this really gives me hope.

I really, really feel like whatever happens in the appeal, this is a tipping point -- this is now the endgame. The opponents can still make plays and still force bloody exchanges of pieces, but they're running out of moves.

there is a reason why this country has checks and balances. And there is a reason why people can’t arbitrarily vote on the rights of others without having to defend this vote in the logical arena of courts, where you can’t invoke panic by proverbially yelling fire in a crowded theatre.

In the courts, you must defend your position. And in the long run, you couldn’t.

Nicely said.

Awesome news! Now same-sex couples can be just as miserable as the rest of us ;-)

IMO, the glue to this decision is that both the lawyer and the judge are conservatives. I like this USA Today headline:

Prop 8 judge to religious believers: It's not about you
