Was a replacement soup warranted? [More:]

We had lunch yesterday at a yummy vegetarian Vietnamese place. The weather was perfect for the curry noodle soup and Mongolian faux-beef that we split. We had about half of the bowl of soup left and were looking forward to eating it for lunch today.

The waiter brought us some boxes, we paid the bill, we left. (An interesting note here: The restaurant is very publicly pro-animal-rights, yet they use styrofoam containers. Good animal people, bad environment people. Go figure.)

GF picked up the soup in its container, walked two steps, and the bottom of the container separated from the top. The soup landed in a wet pile on her shoe.

At the time, we informed the waiter of the soup mishap, apologized, and split. Now, though, I'm thinking that he should have given us another container of soup, given the fact that their crappy box basically ruined half of our order.

I wouldn't have made a scene in the restaurant, but were we entitled to replacement soup?

Yes, definitely. A good serving-person should have offered a replacement - which has been my experience in similar situations in a number of different settings - decent restaurants, Burger King, bars - I've turned from the bar and dropped three of the four drinks of my order before, and they've been quickly replaced, no questions asked). It sounds like the situation couldn't have been your fault, so definitely.

'Entitled' might be a little strong, but, if I was the waitperson, I'd've offered.

Yes - even if it was your fault entirely, a good place would offer to replace it.

I don't think you were entitled to a new soup but any place worth it's salt would have replaced it.

I've had places replace fine meals just because I turned out to be allergic. I think it's just good business sense to keep customers happy when the requyst is reasonable.
I think they should have offered you a half order of soup at least.
