this makes me sick Criminal prosecutions for producing porn? They dragged him down to FL because they knew they wouldn't win a conviction in CA?

The same Alberto Gonazles who decreed the Geneva Convention to be a quaint relic in order to legalize torture announced in 2005 that adult pornography prosecutions would be his "top priority" as Attorney General (at his confirmation hearing, Michael Mukasey assured Hatch he shares the same concerns about "mainstream, adult pornography" as Gonzales did).

What is this, 1950? I thought the case law on this was settled before I was born. WTF.

Other things that make me sick:

* When cops shoot up innocent suspects in the process of apprehending them
* Drug-user busts
* this nonsense

I feel like one of these days totally randomly "they" are gonna come get me and 5am and instead of mercifully shooting me they're gonna shuffle me through bogus charges till I die in custody. [paranoiachat]

I don't consider Salon an objective news source, and none of the news sources I could find gave enough details. Porn charges in this age seem anachronistic and a waste of resources, so I would be more interested in the appeal.

Sadly, this has been case law since the Amateur Action BBS case in 1995. The Feds are allowed to "venue shop". The Bush DOJ made tentative efforts at targeting pornographers, starting with the "extreme" producers Extreme Associates, which led to an overturn on constitutional grounds and a new trial (which hasn't taken place). Max Hardcore was also targeted for the same reason.

They also successfully prosecuted and shut down Red Rose Stories, which published text-only sexual fantasies. Can ASSTR and Literotica be far behind?

In the past, I have seen adult websites that make you click on a disclaimer saying, in so many words, "I am not a resident of Florida, Alabama, county X in state Y" or any other jurisdiction where prosecutions have taken place.
