don't mess with texas... because they'll shoot your ass.
I'm frustrated that the article didn't give details on the burglers' injuries. Injured? Dead?

I can go one better.

Specklet, they both died.

Is it just me, or is their online poll question extremely poorly worded?

Should the homeowner in this case face prosecution?
* No, he was justified
* Yes, we can't have vigilante justice

(So far, 65.6% say he was justified.)

Oh wow. That is really and truly terrible.

It sounds to me like this guy was just itching to use his boomstick on some human meat, for a change.

I thought the dispatcher did a pretty good job, but he could have stalled him a little more, maybe throw in a "police are right around the corner, they'll be there in seconds" line or two.

I hope they sucessfully prosecute that fool for murder. Given the evidence available, a 1L law student ought to be able to get a conviction.

In the case of Mudpuppie's link, there's clearly some complicated stuff going on there, but as I read it, the homeowner was responding to Bad Guys in his home who had committed a violent act against a member of the family. If I imagine myself in the homeowner's position, I cannot say I would do otherwise.

I can abide the use of a firearm in one's own home, in defense of the lives of the members of the household. That's the line. Protecting the sanctity of a neighbor's DVD & Beanie Baby collection falls far short of the line.

Prosecution for what? Being away from home when a neighbor took it upon himself to shoot two burglars?

Texans. Sheesh. ::rolleyes::

Police today identified the dead men as 38-year-old Miguel Antonio DeJesus and Diego Ortiz, 30, both of Houston.

Odd names for two "black" guys. I'm just sayin.

ColfChef, it's possible for people to be both black and Hispanic. This census page says that at in 2002, there were over a million and a half people describing themselves as both. In border states, mixed-heritage populations have existed for centuries; the Spanish even developed a classification system for describing, down to the fraction, how much of what everybody was. Some of that language survives today, even in New Orleans.
