Looking at the definition of obscene, I'd say that in #2, it's the feelings that are (according to #3) disgusting and repulsive, not the object that incites them. And that's based on your value judgement.

If a penis is erected in the forest and no one's around, is anyone offended?

That's the semantic definition of 'obscene,' Eideteker, not the legal definition. Obscenity laws vary in different locales, but most of them (that I know of) factor in whether something would be considered "patently offensive" by "community standards."

Do I think the snow penis should be considered obscene? Nope. Just saying -- it's a bit of a gray area, legally.

I understand that, mudpuppie. What I'm saying is that the people who were offended are wrong.

It's never polite to enforce your internal state or mood on the external world. Didn't Sartre say something about that? I should really bring my copy of Being and Nothingness on the plane with me to Aruba, in case I finish Cloud Atlas.

No, because you think it is wrong, you shouldn't look at it and should form cogent arguments based on fact and logic and then equip those around you with that same reasoning (if you're of a proselytizing mind). Note that smallpox was not wiped out by a direct attack but rather by immunization. I'm tired of the nanny state that thinks it's not better to be exposed to things with a well-equipped mind. And other countries are laughing at us. It's like grade school, all over again.
